1, Heard learned counsel appearing for the petitioner, learned Standing Counsel appearing for the Respondents No. 1 and 2, Sri Ajit Singh, learned counsel appearing for the Respondent No. 3 as well as Sri Tej Bhan Singh and Sri Dinesh Kumar, learned counsel appearing for the Respondents No. 4 and 5.

Petitioner, through this writ petition, has prayed for the following reliefs:-

"I. Issue a writ, order or direction in the nature of mandamus directing/commanding the respondent no. 3 to appoint the petitioner on the post of Assistant Teacher under Dying-in-harness as well as take appropriate action for payment of post retiral benefits of her husband Vivek.

II. Issue a writ, order or direction in the nature of mandamus directing/commanding the respondent no. 3 to comply the order of this Hon'ble court dated 19.07.2023 passed in Writ-A No. 7534 of 2023 (Ram Dulari and another Vs. State of U.P. and others) within stipulated period."

This matter was heard by this court on 22.11.2023 and direction was issued to learned counsel representing the District Basic Education Officer, Kanpur Nagar to take instructions in the matter.

Today, Sri Ajit Singh, learned counsel appearing for the District Basic Education Officer, Kanpur Dehat has produced before this court order dated 4.12.2023 passed by the District Basic Education Officer, Kanpur Dehat whereby settlement in between the petitioner and Respondents No. 4 & 5 has been arrived.

Learned counsel appearing for the petitioner and learned counsels appearing for Respondents No. 4 and 5 have submitted that this writ petition may be disposed of in terms of the order dated 4.12.2023 passed by the District Basic Education Officer, Kanpur Dehat.

In view of the aforesaid agreement entered into between the parties, this writ petition is finally disposed of with a direction to District Basic Education Officer, Kanpur Dehat to implement his order dated 4.12.2023, within a period of three months from the date of presentation of certified copy of this order.

Order dated 4.12.2023 passed by the District Basic Education Officer, Kanpur Dehat is taken on record.
