Petitioner, who is working currently on the post of Senior Technical Assistant Group 'B', wants to forego promotion that has been accorded against the post of Senior Technical Assistant Group 'A' vide order dated 25th May, 2023 passed by the Additional Director Administration, Uttar Pradesh.
Learned counsel for the petitioner submits that promotion order itself provided vide clause 3 that those who wanted to forego their promotion, they were required to file a notary affidavit.
Learned counsel for the petitioner submits that petitioner has already furnished the notary affidavit in the above regard which has been forwarded by the District Agriculture Protection Officer, Kushingar to Additional Director (Administration), Uttar Pradesh on 31st May, 2023, copy whereof has been brought on record as Annexure – 3 to the writ petition. However, no action has been taken in that matter till date.
He submits that respondent No.- 2 may be directed to take appropriate decision in the matter of notary affidavit filed by the petitioner.
Learned Standing Counsel does not have any objection in the above request.
In view of the above, this petition stands disposed of with a direction to the respondent No.- 2 to pass appropriate orders upon the affidavit furnished by the petitioner through proper channel i.e. District Agriculture Protection Officer, Kushinagar on 31st May, 2023 within a period of 30 days' from the date of production of certified copy of this order.
