Heard learned counsel for the parties.

By means of this petition filed under Article 226 of the Constitution, petitioner has claimed salary for the period w.e.f. 20.11.2021 till 20.06.2022.

It transpires that the petitioner was earlier transferred vide order dated 20.11.2021 from Saharanpur to Kheri but he challenged the same vide Writ - A No. 18029 of 2021 and the order of status quo came to be passed only on 31.03.2022. Now resultantly he has been permitted to stay back at Saharanpur by giving him joining on 20.06.2022. Thus, for the interregnum period w.e.f. 20.06.2022 to 20.11.2022 he has not been paid any salary.

Let the matter be examined by the competent authority, the Senior Superintendent of Police, Saharanpur namely the respondent no. 5 to whom representation has been made by the petitioner on 02.09.2023, copy whereof has been brought on record as Annexure No. 7 to the writ petition.

Learned Standing Counsel does not have any objection to the above request, if granted as far as consideration of representation is concerned.

In view of the above, this petition stands disposed of with a direction to the respondent no. 5 to consider the grievance of the petitioner as raised in his representation dated 02.09.2023 and decide the same within a period of three months from the date of receipt of certified copy of this order.

Needless to add that the order to be passed by the competent authority, as directed herein above, shall be reasoned and speaking one.
