Heard learned counsel for the petitioner as well as learned Standing Counsel.

By means of this petition filed under Article 226 of the Constitution, the petitioner is seeking the compassionate appointment on account of death of his mother Smt. Vimla Devi who died in harness on 07.10.2022 while working as 'Safai Karmi' in respondent no. 3 establishment.

Consequently, petitioner submitted an application before the respondent no. 2 on 11.10.2022 for his appointment on compassionate basis as his mother, who was the sole earning member in the family, died in harness, however, his representation has remain undisposed of till date.

Learned counsel for the petitioner therefore, submits that the respondents may be directed to consider the claim of the petitioner for compassionate appointment in accordance with law and pass order accordingly within some time frame that may be fixed by this Court, otherwise the purpose of compassionate appointment gets defeated for the delay if caused by the respondents.

Learned Standing Counsel submits that he has no objection in the event this petition stands disposed of with a direction to the respondent no. 2 to look into and consider the grievance of the petitioner as raised in his representation dated 11.10.2022 and pass appropriate order strictly in accordance with law.

In view of the above, this petition stands disposed of with a direction that respondent no. 2 shall consider the grievance of the petitioner raised in his application/ representation dated 11.10.2022 and decide the same within a period of three months from the date of receipt of certified copy of this order.

Needless to add that the order to be passed by the competent authority, as directed herein above, shall be reasoned and speaking one.
