Petitioner, whose two sons are disabled and currently under treatment at Varanasi, wants transfer from 39th Battalion, PAC, Mirzapur to 36th Battalion, PAC, Ram Nagar, Varanasi.

Learned counsel for the petitioner submits that in above regard petitioner has already approached the commandant 39th Battalion, PAC, Mirzapur vide application dated 30th May, 2023 which was forwarded to Additional Director General of Police, PAC, Headquarters, U.P. Lucknow on 31st May, 2023. However, it is claimed that nothing further has transpired in the matter.

Learned Standing Counsel does not have any objection in the event request of the petitioner is considered in accordance with law by the competent authority.

Having heard learned counsel for the respective parties and having perused the letter of Commandant 39th Battalion, PAC, Mirzapur addressed to Additional General Director of Police, PAC, Headquarters, U.P., Lucknow dated 31st May, 2023, I hereby direct that Additional Director General of Police, PAC, Headquarter to pass appropriate orders upon the papers forwarded by the Commandant 39th Battalion, PAC, Mirzapur vide letter dated 31st May, 2023 within a period of 30 days from the date of production of certified copy of this order.

It is expected that looking to the medical conditions of the two sons of petitioner, the authority shall be giving sympathetic consideration to the request of the petitioner while disposing of the matter of the petitioner.
