It appears that the petitioner does not want to be promoted as Assistant Development Officer, Panchayat and equally therefore, does not want to have any benefit under the Assured Career Progression (ACP) Scheme which otherwise is available as a benefit in the absence of promotional avenues. In this regard various Gram Panchayat Vikas Officers have already approached this Court by filing writ petition and their promotion orders have been stayed. Petitioner submits that even though he has been promoted but he has not joined the promotional post.

The learned Additional Advocate General Mr. Ajit Kumar Singh states that the State Government has already issued notification on 06.10.2022 that those Panchayat Vikas Officers who do not want to be promoted and want to forgo their promotion, have to file affidavit stating therein three statements as contained in the notification.

Learned counsel for the petitioner states that petitioner has already furnished such an affidavit.

In view of the above, this petition stands disposed of with direction to the respondents to pass appropriate orders upon the application of the petitioner dated 12.09.2023 supported by the requisite affidavit in terms of the notification dated 06.10.2022 within a period of 30 days from the date of presentation of certified copy of this order and in the meanwhile for a period of two months or till the decision is taken by the authority concerned, whichever is earlier, the order of promotion issued in relation to the petitioner dated 22.09.2023 shall remain in abeyance and the order of promotion impugned herein this petition shall abide by the decision to be taken, as directed herein above.
