Heard learned counsel appearing for the petitioner, learned Standing Counsel appearing for the Respondents No.1 and 2 as well as Smt. Akanksha Sharma, learned counsel appearing for the Respondents No.3 and 4.

Petitioner through this writ petition has challenged the charge sheet dated 19.6.2023. A specific query was put to the learned counsel appearing for the petitioner as to on what grounds he has challenge the charge sheet. Learned counsel appearing for the petitioner could not submit any reply to the query of the court.

Learned counsel appearing for the petitioner, after arguing at some length, has submitted that he may be permitted to not press the Prayers No.1 and 2 made in the writ petition. Learned counsel appearing for the petitioner has submitted that during pendency of this writ petition, a show cause notice has been issued by the District Basic Education Officer, Moradabad on 17.8.2023, to which petitioner has submitted her reply on 20.9.2023, but due to inadvertent mistake she could not submit few documents which are available with her along with the aforesaid reply. Learned counsel appearing for the petitioner has submitted that this writ petition may be disposed of with liberty to the petitioner to file supplementary reply annexing therewith the relevant documents within two week from today and a direction may be issued to the District Basic Education Officer, Moradabad to take into consideration the said supplementary reply while passing the final order in the matter.

Smt. Akanksha Sharma, learned counsel appearing for the Respondents No.3 and 4 does not have any objection if petitioner is provided two week's time to file her supplementary reply and a direction is issued to the District Basic Education Officer, Moradabad to consider the said supplementary reply at the time of passing of the final order.

In view of the aforesaid submissions made by the learned counsels appearing for the parties, this writ petition is finally disposed of with liberty to the petitioner to submit her supplementary reply to the show cause notice dated 17.8.2023, within two weeks from today and if the said reply is submitted, the District Basic Education Officer, Moradabad is directed to consider the said supplementary reply at the time of passing of the final order in the matter of the petitioner.
