"1. Instructions obtained by Sri Rajesh Srivastava, learned Additional Chief Standing Counsel is taken on record.
2. The controversy was as to whether at sub-centre Rautpur, where the petitioner is working, any ANM was working on the day of transfer and if not, petitioner ought not have been transferred.
3. Instructions obtained today records 50 ANMs working at 36 sub-centres within Khalilabad. Meaning thereby, there are number of sub-centres where only one ANM is working.
4. Chief Medical Officer, Sant Kabir Nagar seems to have tried to mislead the Court on facts. Let him appear before this Court along with entire details on the next date fixed.
5. List on 03.10.2023."
Court. He has also filed an application for exemption of his personal appearance and also annexed the copy of order dated 30.09.2023 by which orders of transfer dated 07.07.2023 and 17.07.2023 have been withdrawn, as such the writ petition become infructuous. The personal appearance of the officer is exempted.
