Learned counsel for the petitioner has made the deficiency of Court fee good in compliance of the earlier order of this Court dated 11.10.2023.

Heard learned counsel for the petitioner, Mr. Shridhar Tripathi, learned Standing Counsel for the State-respondents and Mr. Sudhir Bharti, learned counsel for the respondent- Gaon Sabha.

The instant petition has been filed for mandamus directing the respondent no.3 i.e. Tahsildar Kasya, District- Kushi Nagar to decide the Case No.T201705446504170 (Gaon Sabha vs. Surendra) and Case No.T201705446504171 (Gaon Sabha vs. Ravindra), under Section 67 of U.P. Revenue Code, 2006 within stipulated period.

Learned counsel for the petitioner submitted that in respect to the plot no.180, which is recorded as rasta in the revenue records proceeding under Section 67 of U.P. Revenue Code, 2006 has been initiated, which is still pending even after expiry of six years.

Without expressing any opinion on merits of the case and keeping in view of the facts and circumstances, respondent no.3 is directed to decide the aforementioned cases, under Section 67 of U.P. Revenue Code, 2006 on merits after giving an opportunity of hearing to the parties in accordance with law expeditiously preferably within a period of three months from the date of production of certified copy of this order before him.

Accordingly, the writ petition is finally disposed of.
