Heard Mr. Neeraj Kumar Srivastava, learned counsel for the petitioner, Mr. Diwakar Tiwari & Mr. Gyanendra Singh, learned counsel appearing for private respondents, Mr. Abhishek Shukla, learned Additional Chief Standing Counsel for the State-respondents and Mr. Bhupendra Kumar Tripathi, learned counsel for the respondent- Gram Sabha.

The instant public interest litigation has been filed for mandamus directing respondent nos.3 & 4 to take appropriate legal action for removal of encroachment made by private respondent nos.6 to 13 over Arazi No.2075 Kha, Rakba- 2.1720 hectare and Arazi No.2075G, Rakba- 2.6430 hectare, situated at Village- Kantit, Tahsil- Sadar, District- Mirzapur as well as for mandamus directing respondent nos.3 & 4 to decide the application / representation dated 25.4.2023 in accordance with law.

Counsel for the petitioner submitted that the private respondent are in illegal possession of public utility land, as such, immediate action be taken for the removal of encroachment from the public utility land.

Mr. Diwakar Tiwari & Mr. Gyanendra Singh, learned counsel appearing for private respondents submitted that the lease was executed in respect to the plot in dispute in the year 1972. They further submitted that no proceeding for cancellation of lease has been initiated, as such, there is no question for removal of encroachment over the plot in dispute. They further submitted that the instant public interest litigation has been filed with malafide intention. They further placed the report dated 10.4.2023 submitted in the matter which has been annexed as Annexure No.3 to the writ petition in order to demonstrate that there is no encroachment over the plot in question.

Mr. Abhishek Shukla, learned Additional Chief Standing Counsel on the basis of instruction dated 10.7.2023 submitted that the facts mentioned in the instant public interest litigation are not correct, as such, the instant public interest litigation is liable to be dismissed. He further placed the instruction sent by the Sub-Divisional Officer, Mirzapur dated 10.7.2023.

I have considered the argument advanced by learned counsel for the parties and perused the record.

In order to appreciate the controversy involved in the matter, perusal of the report dated 10.4.2023, which has been annexed as Annexure No.3 to the instant public interest litigation will be relevant, which is as under:

Considering the instruction dated 10.7.2023/ report dated 10.4.2023 submitted by the revenue authorities as well as argument advanced by learned counsel for the parties, it appears that the lease has been executed in favour of respondent nos.6 to 13 in the year 1972 and they are accordingly, recorded as well as in possession over the same on the basis of lease, as such, unless the lease is cancelled in accordance with law no order can be passed for removal of encroachment over the same.

Considering the entire facts and circumstances, no interference is required in exercise of jurisdiction under Article 226 of the Constitution of India on the basis of instant public interest litigation.

The instant public interest litigation is dismissed.
