1.In compliance of the order of this court dated 19.09.2023, instruction dated 05.10.2023 has been placed before this court, which is taken on record.

Heard Counsel for the petitioner, Mr. Abhishek Shukla, learned Additional Chief Standing Counsel for the Staterespondents and Mr. Azad Rai, Counsel for 4/Gram Panchayat/Land Management Committee.

Mr. Abhishek Shukla, learned Additional Chief Standing Counsel for the State-respondents on the basis of the instruction submitted that in respect to the plot No.1155-Ga, proceeding under Section 67 (1) of U.P. Revenue Code, 2006 has been initiated and three cases have been registered.

Particular of cases under Section 67 (1) of U.P. Revenue Code, 2006 are as follows:

It is further mentioned that next date has been fixed in the aforementioned case 19.07.2023.

Counsel for the petitioner submitted that proper direction be

issued for the expeditious disposal of aforementioned cases so that the encroachment over the land in question be removed.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present Public Interest Litigation stands disposed of finally with a direction to Tehsildar, Phoolpur, Prayagraj to consider and decide the aforementioned three pending cases in accordance with law expeditiously and preferably within a period of four months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned.

Learned Additional Chief Standing Counsel for the Staterespondents shall serve the copy of the instruction upon counsel for the petitioner during course of the day.
