The instant Public Interest Litigation has been filed by the petitioner- Ram Naresh with a prayer to issue a writ in the nature of Mandamus directing respondent no.2 to make investigation in the matter with regard to the construction of 'Nala' work only on paper from Bazaha Bhit Puliya to the field of Vinod Kumar, from the field of Yamuna to the field of Ram Dularey and from the house of Chedi Lal to Pitch Road but no work has been done on spot under MNREGA Scheme in Village Atawaliya, Block Kala Kankar, Pargana Manikpurm, Tehsil Kunda, District Pratapgarh, and punish to the persons who are involved in the matter.
Learned Standing Counsel pointed out that during enquiry a sum of Rs.1,81,089/- was determined for recovery against three persons by order dated 13.10.2022 issued by District Panchayat Raj Officer for the recovery of the said amount under the U.P. Panchayati Raj Adhiniyam, 1997.
In view of the above, the instant Public Interest Litigation may be consigned to record , leaving it open to the Competent Authority to proceed in accordance with law, in pursuant to the order dated 13.10.2022.
