The grounds taken by the applicants for transferring the aforesaid case are that opposite party no. 2 lodged an F.I.R. bearing Case Crime No. 0073 of 2016, under Section 498-A, 323, 504, 506 I.P.C. and Section 3/4 Dowry Prohibition Act, Police Station Ekdil, District Etawah against the applicants and three other family members in which the applicants were granted bail. The opposite party no. 2 also filed a case under Section 12 of Domestic Violence Act against the entire family of the applicants, which is pending in the court of learned Additional Chief Judicial Magistrate-II, Etawah. In the said case, date was fixed on 27.06.2022 and the applicants went to the District Court, Etawah for attending the court proceedings where in the court premises, the opposite party no. 2 with his brothers and father assaulted the applicant by Lathi, Danda, legs and fits and anyhow on the intervening of advocates, they saved themselves. He further submitted that in the aforesaid incident, the applicant no. 2 received injuries and after obtaining the injury report, she lodged an F.I.R. in Case Crime No. 242 of 2022, under Sections 323, 504, 506 I.P.C. against the opposite party no. 2 and her family members. The opposite party no. 2 and her family members exhorted and extended threat to the applicants for dire consequences if they came to attend the further proceeding of any case registered against them in District Court, Etawah.
