Heard learned counsel for the applicants, learned A.G.A. for the State and Sri Alok Mishra, learned counsel for the opposite party nos. 2 to 6.
The present transfer application has been filed with prayer to transfer Misc. Case No. 62 of 2021 (Smt. Khushbu Vs. Pradeep alias Kalua and others), under Section 12 of Domestic Violence Act, Police Station Kakod, District Bulandshahar to District Aligarh, which is pending before the Chief Judicial Magistrate, Bulandshahar.
At the very outset, learned counsel for the opposite party nos. 2 to 6 has produced a copy of an order dated 21.01.2023, which is taken on record. On the basis of said order, learned counsel for the opposite party nos. 2 to 6 submitted that Misc. Case No. 62 of 2021 (Smt. Khushbu Vs. Pradeep alias Kalua and others), under Section 12 of Domestic Violence Act, Police Station Kakod, District Bulandshahar, which is prayed to be transferred to District Aligarh in the present transfer application, has been decided in favour of opposite party no. 2 vide order dated 21.01.2023 by Civil Judge (Junior Division)/Fast Track Court/Judicial Magistrate, Court No. 2, Bulandshahar. Therefore, this transfer application has become infructuous and it may be dismissed, to which learned counsel for the applicants and learned A.G.A. have no objection.
In view of the above, this transfer application is dismissed.
