Heard Sri Ram Krishna Koli, learned counsel for the petitioner, Sri Saurabh Tripathi, learned counsel for the petitioner no.2 and Sri Ankit Singh, learned counsel appearing on behalf of respondent no.-6 as well as learned A.G.A. for the State.

This habeas corpus petition has been filed on behalf of petitioners with the allegation that the petitioner no.2 is legally wedded wife of petitioner no.1 and petitioner nos. 3 to 5 children of petitioner no.1. It is further alleged in the petition that the petitioner nos. 2 to 5 are illegally detained by respondent no.6.

In compliance of order dated 12.05.2023, the corpus, namely Smt. Neelam appeared before the Court. On being asked she has stated that there is some dispute between husband and wife and she along with children lives separately with petitioner no.1. She has denied that she is illegally detained by respondent nos. 4, 5 and 6.

In view of statement of corpus, namely Smt. Neelam that she is not in any illegal detention, no cause of action survives and the present habeas corpus petition is liable to be dismissed.

The present habeas corpus petition is dismissed , accordingly.

Notices issued to respondent nos. 4, 5 and 6 stand discharged.
