Heard learned counsel for the petitioners, learned A.G.A. for the State, Sri Ankit Srivastava, learned counsel appearing for respondent nos.4 & 5 and perused the record.

This habeas corpus petition has been filed on behalf of Pooja Sharma/petitioner no.1 through her friend Abhishek Sharma/petitioner no.2 with the allegation that corpus is illegally detained by respondent nos.4 and 5, who are sister and brother of corpus.

In compliance of orders dated 11.7.2023, 3.8.2023 and 11.8.2023, the corpus namely, Pooja Sharma is produced before this Court by Sub Inspector Ajay Prasad, Police Station Quila, District Bareilly.

On being queried, the corpus namely, Pooja Sharma denied her illegal confinement by respondent nos.4 and 5. She states that now she is willing to go with Abhishek Sharma/petitioner no.2.

In view of the statement of corpus namely, Pooja Sharma, she cannot said to be in illegal confinement of respondent nos.4 and 5. The corpus Pooja Sharma is major and she is free to go anywhere of her choice. No cause of action survives. The petition has no force and is liable to be dismissed.

The present habeas corpus petition is dismissed, accordingly.

Learned Registrar General of the Court is requested to hand over the bank draft of Rs.50,000/- to the corpus namely, Pooja Sharma immediately, which was deposited by the petitioner no.2 in her name in compliance of order dated 23.5.2023.
