The instant appeal is listed today under Chapter XII Rule 4 of the High Court Rules, 1952.
This was the same position on 13.10.2023 when the Court had passed the following order which reads as under:
"The present matter is listed under Chapter 12 Rule 4 of the Allahabad High Court Rules, 1952.
The record indicates that the matter was listed on 21.09.2023 under Chapter 12 Rule 4 of the Allahabad High Court Rules.
The appellant was granted time to take steps, however, as per the office report dated 09.10.2023, the steps have yet not been taken.
The learned counsel for the appellant shall take fresh steps for the unserved respondent within a period of ten days from today, returnable at an early date failing which the appeal shall stand dismissed without further recourse to the Court. In case if the steps are not taken within the aforesaid period, the matter shall be listed under the appropriate heading immediately after the expiry of the aforesaid period."
Since the steps have not been taken in terms of earlier order, accordingly, the instant appeal automatically stands dismissed . Consigned to record.
