Shri Ashish Chand Asthana, learned counsel appearing for the appellant-State has moved the instant application seeking withdrawal of the instant first appeal as not pressed which is supported by an affidavit of Shri Sudhir Kumar who is currently posted as Irrigation Department, Basti.
The submission of the learned counsel for the appellant is that during pendency of the instant appeal which related to certain acquisition of land in terms whereof the amount of compensation has already been paid to the respondents and as such in view thereof the appellant does not wish to press the instant first appeal.
In view of the aforesaid, the application is allowed and the instant first appeal is dismissed as not pressed.
