Grievance of the petitioner is that though various acts of commission and omission constituting offence, are committed by the second respondent, but sanction under Section 197 is not being granted to prosecute the second respondent before the concerned authority.
Learned counsel for the banks states that no such complaint has ever been instituted against the second respondent in the matter.
In the facts of the case, we permit the petitioner to withdraw the writ petition with the liberty to make a representation, in respect of his grievance against the second respondent on which the bank undertakes to make necessary inquiry and take appropriate decision.
Subject to the observations made above, the writ petition stands disposed of .
