The impugned judgement acquitting the opposite party nos. 1,2, and 3 is dated 31.01.2020 and the appeal has been filed on 06.10.2020. As per office report, there is delay of 139 days in filing the appeal. The grounds mentioned in the affidavit filed in support of delay condonation application are that the certified copy of the judgement and order was applied on 04.02.2020 which were received on 26.02.2020. Thereafter, District Government counsel prepared the proposal for filing the criminal appeal, which was sent to the District Magistrate concerned on 10.06.2020. After the approval of the District Magistrate, on 26.06.2020 the record was sent to the Law Department, Government of U.P. Lucknow. Thereafter on 27.07.2020, an order was issued for filing appeal mentioning that limitation for filing of criminal appeal had already expired on 30.05.2020. Thereafter file was received in the office of Government Advocate, Allahabad High Court on 24.07.2020. Thereafter communication was sent to the District Magistrate, Hathras for sending an official for swearing the affidavit and then only present criminal appeal could be filed and prayer is made to condone the delay.
