As per the facts of the case, an application u/s 156(3) Cr.P.C. was moved by the appellant on 21.12.2021 with the allegation that the appellant had some dispute with his son Mohit and in this regard on the request of Poonam, the wife of his son Mohit, he was called by the Chawki Incharge Santosh Kumar Yadav, the opp. party no. 2, on 15.11.2022 at 9.53 A.M. telephonically. The appellant along with his wife Jiuta Devi went to Chawki Purvanchal, Jaunpur. His son Mohit along with his wife Poonam, Munshi Lal, Rajkumar and Poonam's mother Saraswati was sitting near Chawki Incharge Santosh Kumar Yadav. The appellant also called his another son Rohit on the instruction of Chawki Incharge, who came there along with one Virendra. When they all gathered at the chawki Purvanchal, the Chawki Incharge Santosh Kumar Yadav at 12.15 P.M., hurled caste based abuses and assaulted him with a baton. Rohit and Virendra were also thrashed by him and all the three were forced by Chawki Incharge for compromise. The appellant became agree for the compromise. Chawki Incharge demanded Rs. 5000/- for the same. When he did not pay this amount he was kept in the lock-up of the police station Sarai Khwaja, District Jaunpur.
