Heard learned counsel for the appellant, learned counsel for opp. party no. 2, learned A.G.A. for the State- and perused the record.

This criminal appeal has been preferred against the order dated 9.2.2023 passed by Addl. District and Sessions Judge/ Special Judge SC/ST Act, Sidharthnagar in Special Criminal Case No. 63 of 2023, case crime no. 254 of 2022, State Vs. Binda Pandey, under section 353, 352, 504, 506 I.P.C, section 3(1)(da), 3(1) (dha) and 3(2)(va) of SC/ST Act, police station Bansi District Sidharthnagar, whereby the appellant has been summoned to face trial under the aforesaid sections.

In the Court, learned counsel for the appellant only submitted that some direction be issued to the Court concerned regarding bail as she wants to surrender before the trial court.

The appeal is, therefore, disposed of with the direction to the trial court that if the appellant appears before the trial court within 15 days from today and moves an application before the trial court, the same shall be disposed of as soon as possible in view of the law laid down in Satender Kumar Antil Vs. Central Bureau of Investigation and another, (2021) 10 SCC 773.
