- The present appeal under Section 374 (2) Cr.P.C has been preferred by the appellant against the judgment and order dated 16.7.2004.

- As per the office report dated 26.4.2023, a report of C.J.M., concerned dated 22.8.2022 has been received stating therein that the sole appellant Karimuddin has died on 25.11.2015. The said report has been sent after due inquiry.

- This Court has perused the said report which states that the accused-appellant Karimuddin has died on 25.11.2015.

- In view of the above, the appeal stands abated.
