Proceeding of criminal contempt was initiated against the opposite parties on the basis of a reference received from the then District Judge, Azamgarh. An incident occurred on 12.3.2021 at 11.25 a.m. when the presiding officer was holding the court and Civil Misc. Case No.106 of 2009 (Ram Sakal Vs. Vijay Shankar) was being heard. The main contemnor Ram Pyare Singh, who was the President of Bar Association, alongwith other contemnors entered the court of District Judge and indulged in unruly acts apart from making derogatory remarks and using unparliamentary comments against the presiding officer.

The main contemnor, who was leading the delegation on account of some issue of lawyers and by which the advocates apparently were agitated, has already died. 27 other contemnor lawyers have appeared before the presiding officer, who is presently posted at Chitrakoot, and have offered their unconditional apology. A communication has been received from the presiding officer that the advocates have shown remorse and have submitted their unconditional apology before him. The apology has been offered both verbally and in writing. Communication is received from the judicial officer stating that in view of the subsequent unconditional apology tendered by the contemnors, this Court may consider acceptance of apology and thereby close the proceedings.

Sri A.N.Singh, Senior Advocate assisted by Sri Shaurya Sharma and Sri Rajeev Upadhyay appearing for the contemnors have invited our attention to the subsequent affidavit filed by the contemnors extending an assurance to the Court that they shall not indulge in any such undesirable act in future and have submitted their unconditional apology.

In view of the subsequent act of contemnors showing remorse at their previous conduct and also expressing unconditional apology, we accept the unconditional apology of the contemnor Advocates and drop the proceedings of contempt. It is, however, expected that the contemnors shall maintain high standards of professional ethics while appearing in the courts, and any recurrence of undesirable activity, on their part, shall be viewed seriously.

Subject to the observations made above, proceedings of instant contempt are consigned to records.
