Heard Mr. Syed Faiz Hasnain, the learned counsel for applicant, the learned A.G.A. for State and Mr. Ram Sajiwan Prajapati, the learned counsel for first informant/opposite party-2.
Learned counsel for accused/opposite party-2 has filed short counter affidavit in Court today which is taken on record.
Learned counsel for accused-opposite party-2 submits that in compliance of earlier order dated 22.12.2023, opposite party-2 has already deposited the requisite amount with the Court below. The document in proof of the said fact has been brought on record as Annexure- S.C.A-2 to the short counter affidavit. In view of above, it is thus urged that since no condition of bail stands infringed on date, the bail cancellation application has been rendered infructuous. The same be dismissed as such.
Learned counsel for applicant could not dislodge the submissions urged by learned counsel for first informant/opposite party-2.
In view of above, present bail cancellation application fails and is dismissed as having rendered infructuous.
