Heard learned counsel for the applicant and Sri Vishwa Deepak Mishra, learned A.G.A. for the State and perused the record.
The instant bail application has been filed on behalf of the applicant with a prayer to release him on bail in Case Crime No.142 of 2022, under Sections 147, 148, 149, 307, 308, 352, 452, 323, 504, 506, 325 I.P.C., P.S. Gambhirpur, District Azamgarh, during pendency of the trial.
Learned counsel for the applicant submitted that applicant is innocent and has falsely been implicated in the present case due to political rivalry. In the F.I.R. role of causing injury has been assigned to co-accused Sajman, who has been granted bail by this Court vide order dated 30.1.2023 passed in Crl. Misc. Bail Application No.59678 of 2022. In supplementary affidavit, injury report of Purendra has been annexed which shows that injured Purendra received 9-10 injury and all injuries are simple in nature and are not on vital part of the body. The applicant has no criminal history. Moreover, there is no prospect of trial of the present case being concluded in near future. The applicant is languishing in jail since 30.11.2022 and in case he is enlarged on bail he will not misuse the liberty of bail and co-operate in trial.
