Heard learned counsel for the applicant and learned A.G.A. for the State-opposite party.

The instant bail application under Section 439 Cr.P.C. has been filed with the prayer to enlarge the applicant on bail in Case Crime No. 46 of 2015 under Sections 308, 323, 504 and 506 I.P.C., Police Station- Sisolar, District- Hamirpur, during the pendency of the trial.

It is submitted that the applicant has been falsely implicated in the instant case. The injuries sustained by the injured Bhau Singh @ Veer Singh are simple in nature. It is next contended that the injured, PW-1 during his cross-examination in the trial, has not supported the prosecution version. The statement of the injured is annexed as S.A. 2 to the supplementary affidavit. The criminal history of the applicant has been explained in para nos. 3 to 9 of the supplementary affidavit. The applicant is in jail since 25.08.2022., and in case he is enlarged on bail, he will not misuse the said liberty.

Learned A.G.A. has opposed the prayer for bail but could not satisfactorily dispute the aforesaid submissions from the record.

Having regard to the submissions made but without commenting on merits of the case, I am of the opinion that the applicant is entitled to be enlarged on bail.

Let the applicant- Dheer Singh @ Bully Singh , involved in the aforesaid case be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of court concerned on the following conditions that :

the applicant shall not tamper with the prosecution evidence;

the applicant shall not pressurize the prosecution witnesses;

¶13

the applicant shall appear on each and every date fixed by the trial court.

In case of breach of any of the above conditions, the prosecution shall be at liberty to move bail cancellation application before this Court.
