Heard learned Counsel for the applicant and learned A.G.A. for the State.

The instant bail application, under Section 439 Cr.P.C., has been filed with a prayer to enlarge the applicant on bail in Case Crime No. 0106 of 2022, under Sections 419, 420, 467, 468, 471, 120-B I.P.C., Police Station- Aliganj, District- Etah.

It is contended that the applicant has been falsely implicated in the present case. The applicant is a Lekhpal posted at Mathura. The applicant has no concern with the LIC Housing Finance Limited, Area Office M.G. Road Agra. No amount has been credited in the account of the applicant. The applicant is not a beneficiary of any illicit transaction. The outstanding loan amount has already been credited on 30.8.2022. The prosecution evidence does not connect the applicant with the offence. The applicant has not provided any reference for sanction of loan. It is next contended that the co-accused Sonu has been granted bail by this Court in Criminal Misc. Bail Application No.43272 of 2022 on 6.1.2023. The applicant is in jail since 15.5.2022. In case, he is enlarged on bail, he will not misuse the liberty of bail.

Learned A.G.A. has opposed the prayer for bail but could not satisfactorily dispute the aforesaid submissions from the record.
