Learned counsel for the applicant has submitted that the first information report is based on false and fabricated facts. The accused/applicant is innocent who has been falsely implicated in this case. He has also submitted that the applicant and the victim fell in love with each other and solemnized their marriage in Arya Samaj Temple, Tis Hazari, Delhi, thereafter, they started their marital life and after that they had visited several places, but no hue and cry or alarm had been raised by her as she was the consenting party with the applicant/accused. There are several photographs in which the applicant/accused and the victim are sitting together and are performing several activities whereas no sign of duress, coercion or undue influence upon the victim was there, in some photographs, female family members of the applicant/accused are also accompanying the victim and the victim is leading herself. He further contends that at present, except the allegations, there is no iota of evidence in support of the prosecution version. Actually, the victim belongs to Brahmin family and the applicant is a member of Scheduled Caste, therefore, when parents of the victim came to know about the marriage between the applicant and the victim, they persuaded the victim to lodge the F.I.R. and file the petition for declaring their marriage to be null and void. He further contends that the victim is a graduate lady and well conversant with the affairs of the marriage and with the court proceedings.
