He further pointed out that in her statement, under Section 164 Cr.P.C., she has admitted that she had not made any effort to flee away from that place and also not raised alarm anywhere, neither in Lalitpur nor in Indore. The victim has also admitted that she had given some false statements under Section 161 Cr.P.C. on the pretext of the lady Police Constable. Similarly in her additional statement, she has stated that she has falsely stated in her statement under Section 164 Cr.P.C. that mother of the accused/applicant had also accompanied her on motorcycle. He further contends that the allegations levelled by the victim against the applicant in the F.I.R. have not been corroborated from the medical evidence. Doctor has not found any internal or external injury on her body. So far as the status of hymen is concerned, it was found old torn and healed. He further submits that victim has changed her version minute to minute. Contrary to the statements under Section 161 and 164 Cr.P.C. and in her additional statement, she has stated before the Doctor that at the time of her kidnapping, applicant Sonu and his sister-in-law ( Bhabhi ) were also present there and thus she also tried to involve applicant's sister-in-law in her kidnapping. He further submitted that, normally, the Court should not rely on the statement of such victim of rape who is changing her statement in the manner as narrated above. He further contends that though the Court and the prosecution can go ahead solely on the basis of the statement of the victim of rape, but if it appears that the statement of the victim of rape is so untrustworthy, the Court should seek corroboration of said allegations with other reliable evidence. Lastly it is submitted that the accused applicant is hardly 21 years of age and he is languishing in jail since 09.03.2021, having no previous criminal history to his credit and his trial has not yet been started. His further submission is that in case the applicant is enlarged on bail, he will not misuse the liberty of bail and he will also fully cooperate with the trial court in getting the trial concluded expeditiously. He has also submitted that the applicant will not intimidate or pressurize the witnesses or any other persons acquainted with the facts of the present case.
