Heard learned counsel for the applicant and learned Additional Government Advocate representing the State.

By means of this application under Section 439 of Cr.P.C., applicant, who is involved in Case Crime No. 211 of 2022, under Sections 452, 323, 324, 504, 506, 308, 304 IPC, police station Kayamganj, district Farrukhabad, seeks enlargement on bail during the pendency of trial.

As per prosecution case, in brief, the informant, who is relative of deceased, lodged a first information report on 21.6.2022 against the present applicant Ranveer Singh and Trilok Kumar making allegations inter alia that the applicant and co-accused Trilok Kumar under the influence of liquor entered into his house and caused injuries to Bharat Singh, Chandra Shekhar and Ravi whereby Bharat Singh succumbed to the injuries.

It is contended by learned counsel for the applicant that in fact both sides under the influence of liquor assaulted each other. In support of his submission, he referred to the injuries of Trilok Kumar, who received three injuries. It is also submitted that since co-accused was arrested on 21.6.2022 and the applicant was arrested on 29.6.2022, therefore, they could not lodge FIR from their side. Much emphasis has been given by contending that the prosecution has not come with clean hand as there is no explanation of the injuries of Trilok Kumar, which was examined under the supervision of police on 22.6.2022. It is also contended that co-accused Trilok Kumar has been granted bail by the Coordinate Bench of this Court in Criminal Misc. Bail Application

No. 53340 of 2022 vide order dated 21.12.2022 and on the ground of parity the applicant is also entitled to be released on bail.

Lastly, it is submitted by the learned counsel for the applicant that there is no chance of the applicant fleeing away from the judicial process or tampering with the prosecution evidence. The applicant does not have any criminal history and is languishing in jail since 29.6.2022 and in case, he is released on bail, he will not misuse the liberty of bail and cooperate with the trial.

Per contra, learned Additional Government Advocate opposed the prayer for bail of the applicant, but could not dispute the above factual aspect of the matter as argued on behalf of the applicant.

Having heard learned counsel for the parties and examined the matter in its entirety, I find that there is no dispute about the fact that incident took place under the influence of liquor and both sides have received injuries and from the side of the applicant co-accused Trilok Kumar has also received injuries as noted above.

Considering the facts and circumstances of the case as well as keeping in view the nature of the offence, evidence, complicity of the accused and submissions of the learned counsel for the parties, this Court is of the opinion that the applicant has made out a case for bail. Hence, the bail application is hereby allowed.

Let the applicant Ranveer Singh, be released on bail in the aforesaid case crime number on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:

(i) That the applicant shall cooperate in the expeditious disposal of the trial and shall regularly attend the court unless inevitable.

(ii) That the applicant shall not directly or indirectly make any inducement, threat or promise to any

person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police ofÏcer or tamper with the evidence.

(iii) That after his release, the applicant shall not involve in any criminal activity.

¶19

(iv) The identity, status and residential proof of sureties will be verified by court concerned before the release of the applicant.

¶20

In case of breach of any of the conditions mentioned above, court concerned will be at liberty to cancel the bail of the applicant.
