By means of this application under Section 439 of Cr.P.C., applicant, who is involved in Case Crime No. 80 of 2022, under Sections 147, 148, 149, 302 of I.P.C., Police Station-Dibiyapur, District-Auraiya, seeks enlargement on bail during the pendency of trial.
On the matter being taken up, learned A.G.A. for the State pointed out that in Paragraph No. 26 of the afÏdavit, it is mentioned that applicants have no criminal history to their credit whereas both the applicants are having criminal history of one case each apart from this case.
On the said submission of learned A.G.A. for the State, learned counsel for the applicant submits that he may be permitted to withdraw this bail application with liberty to file fresh application.
In view of the above, the instant application is dismissed as withdrawn with liberty to file fresh application.
OfÏce is directed to return the certified copy of the F.I.R. and free copy of bail rejection order dated 05.11.2022 to the counsel for the applicant within a week after retaining the xerox copy of the same on record.
