though in postmortem ribs were found fractured and as a result of ante-mortem injuries he died. Leaned counsel has next argued that the applicant and the co-accused namely, Balram Dwivedi, Chota Dwivedi and Dinesh Dwivedi have been assigned the role of causing injuries with lathi, danda, fist and kicks and they have been granted bail by co-ordinate Bench of this Court vide order dated 20.10.2022 passed in Criminal Misc. Bail Application No. 56102 of 2021, copy of which order is annexed as Annexure-7 to the affidavit accompanying the bail application. It is thus contended that the applicant is also entitled to be enlarged on bail on the ground of parity. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been mentioned. It has also been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required and is also ready to accept all the conditions which the Court may deem fit to impose upon him. He next submits that applicant is languishing in jail since 17.10.2021. 3. L earned A.G.A. has opposed the prayer for bail and argued that the applicant has criminal history of ten cases.
