stating inter alia that from the relation of the applicant, she became pregnant and thereafter, the applicant gave her medicine, which she consumed on her own volition. When she became ill, she told everything to her mother and got her foetus aborted by Dr. Aslam, who also gave medicine to her but during investigation, Dr. Aslam denied the statement of the victim and after culmination of the investigation, charge-sheet has not been submitted against the applicant under Section 313 IPC. Lastly, it is submitted that in fact, the victim was having love affair with the applicant. When her parents came to know about her love affair with the applicant, her mother lodged the F.I.R. on the false and concocted facts. The applicant does not have any criminal history to his credit. Lastly, it is submitted by the learned counsel for the applicant that there is no chance of the applicant fleeing away from the judicial process or tampering with the prosecution evidence. The applicant is languishing in jail since 07.09.2022 and in case, the applicant is released on bail, he will not misuse the liberty of bail and cooperate with the trial.
