Heard learned Counsel for the applicants and learned A.G.A. for the State.

The instant bail application under Section 439 Cr.P.C. has been filed with the prayer to enlarge the applicants on bail in Case Crime No.27-F of 2015, under Sections 419, 420, 467, 468, 471, 406, 504, 506 IPC, Police Station Kotwali, District Gorakhpur during the pendency of the trial.

It is submitted that applicant No.1 is the daughter, applicant No.2 is daughter-in-law, applicant No.3 is family friend and applicant No.4 is servant of the then Manager of Raj School of Nursing and Paramedical College, Gorakhpur (in Short 'College') and have been falsely implicated in the instant case. The applicants are neither employee of the aforesaid college nor they were associated in any manner with the working of the said College. There is no direct or indirect evidence regarding the involvement of the applicants in the instant case. It is next contended that on similar allegations, number of First Information Reports were lodged against the applicants and in the said cases, applicants have been granted bail by this Court, vide orders dated 20.12.2022, 19.12.2022, 14.12.2022 and 19.12.2022 passed in Criminal Misc. Bail Applications No. 58205 of 2022, 57720 of 2022, 54994 of 2022 and 57784 of 2022 respectively. Copy of the said orders are taken on record. The applicants are languishing in jail since 17.9.2022. In case, they are enlarged on bail, they will not misuse the liberty of bail.

Learned A.G.A. has opposed the prayer for bail but could not satisfactorily dispute the aforesaid submissions from the record.

Having regard to the submissions made but without commenting on merits of the case, I am of the opinion that the applicants are entitled to be enlarged on bail.

Let the applicants, Dr. Poonam Yadav, Smt. Maneesha Yadav, Shyam Narayan Maurya and Shobhita Nandan Yadav involved

in the aforesaid case be released on bail on their furnishing a personal bond and two sureties each of the like amount to the satisfaction of court concerned on the following conditions that:

the applicants shall not temper with the prosecution evidence;

¶13

the applicants shall not pressurize the prosecution witness;

¶14

the applicants shall appear on each and every date fixed by the trial court.;

¶15

In case of breach of any of the above conditions, the prosecution shall be at liberty to move bail cancellation application before this Court.
