Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

The present application under Section 439 Cr.P.C. has been filed seeking bail in Case Crime No.R.C. No.1202018A0008, under Sections 120B, 420, 468, 471 IPC read with Section 13(1)(D), 13(2), 13(1)(C) Prevention of Corruption Act, 1988, Police Station C.B.I., A.C.B., Ghaziabad.

Learned counsel for the accused applicant submits that accused applicant has received Rs.7,97,500/- in his Bank account and he has prepared a bank draft of Rs.10 lakh in the name of Bank Manager of Indian Overseas Bank, Shamli which he shall deposit in the said account and submit proof thereof with the bail bonds. He also submits that some of the co-accused have been enlarged on regular bail/ anticipatory bail on the condition of depositing the entire amount which they have received in their bank account.

Sri Sanjay Kumar Yadav, learned counsel for the CBI does not dispute the fact that except Rs.7,97,500/-, no other amount has been received in the bank account of the accused applicant and some other co-accused have been granted regular bail/ anticipatory bail on condition of depositing the entire amount those accused have received in their bank.

Considering the aforesaid facts and circumstances of the case and without expressing any opinion on the merits of the case, this Court is of the view that accused applicant is entitled to be admitted on bail

Let applicant- Musarraf Ahmad be released on bail in the above mentioned case crime number on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of Court concerned with the following conditions :-

(i). The accused applicant shall deposit the bank draft of Rs. 10,00,000/- dated 30.01.2023 bearing No.406607 drawn in favour of Branch Manager, Indian Overseas Bank, Shamli, without any prejudice to his rights and contention in the trial.

(ii). The accused applicant shall submit proof of deposition of the Bank Draft with the bail bonds.

(iii) That the accused-applicant shall make himself available for interrogation by police authorities as and when required and will cooperate with the investigation;

(iv) That the accused-applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer; and

(v) That the accused-applicant shall not leave India without previous permission of the Court.

In case of breach of any of the said conditions or in case it is otherwise found for any other reason the bail is required to be cancelled, it shall be open for the State or the appropriate authority to move an application for cancellation of bail in accordance with law.
