1. Heard learned counsel for the applicant and learned A.G.A. on behalf of State and perused the record.

1. The instant bail application has been filed on behalf of the applicant, with a prayer to release him on bail in Case Crime No. 99 of 2023, under Section 2/3 Gangster and Anti Social Activities (Prevention) Act, 1986, Police Station Loni Border, District Ghaziabad, during pendency of trial.

1. It is submitted by learned counsel for the applicant that applicant is innocent and has been falsely implicated in the present case due to ulterior motive. He further submits that three cases are shown against the applicant in the gang chart, in which the applicant has been enlarged on bail. Copies of the bail orders have been annexed with the bail application. He next argued that identically placed co-accused Vicky @ Vikas Langada has been granted bail by the co-ordinate Bench of this court vide order dated 17.05.2023 passed in Criminal Misc. Bail Application No. 22174 of 2023. The applicant is in jail since 17.03.2023. In case, the applicant is released on bail, he will not misuse the liberty of bail and will cooperate in trial.
