WhatsApp messages which have been annexed as annexure 7 to the affidavit, it is argued that the applicants are not named in any of the messages. It is argued that in the said messages, Mukesh, Guddu Seth and Deepak Bhai are the three named persons. It is further argued that with regard to the photographs, the said WhatsApp had the photographs of the deceased and the daughter of the applicant no. 1. It is argued that the said WhatsApp messages are not incriminating in any manner in so far as the applicants concerned. It is further argued while placing the statement of Bhanendra, the Admin of the WhatsApp group 'Ram Ram Ji', the copy of which is annexed as annexure 9 to the affidavit that he has seen that photograph posted on the said group was of the deceased and the daughter of the applicant no. 1 / Israr. It is argued that even the said photograph was no objectionable in any manner as there is nothing on record to show that the same was objectionable. It is argued that till date no video has been recovered by the Investigating Officer. It is argued that applicants have no criminal history as stated in paragraph 30. It is further argued that the present case is a case of circumstantial evidence and there is no eye witness of the murder. It is next argued that the applicants are in jail since 12.9.2022.
