The submission advanced by learned counsel for the applicant is that the applicant is innocent and has been falsely implicated in the present case due to ulterior motive. According to supplementary medical examination of the victim, no internal or external injury was found on the body of the victim, There are contradictory statements of the victim recorded under section 161 and 164 Cr.P.C. The applicant and victim were neighbour to each other, they have friend ship, talking on mobile phone, this incident was seen by the brother of the victim and badly beaten to the victim as well as applicant, consequently they sustained serious injuries. The applicant was medically examined. But under the pressure of her brother, a false FIR has been lodged by the victim against the applicant (Annexure No. 9 to the affidavit). The victim appears to be consenting party with the applicant. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been mentioned. It has also been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required and is also ready to accept all the conditions which the Court may deem fit to impose upon him.
