Learned counsel for the applicant submits that the applicant is wife of the deceased and has been falsely implicated in the present case. He submits that applicant is not named in the FIR. The name of the applicant surfaced along with that of Vipin, cousin of the deceased, of having some illicit relation for which the two have murdered informant's son. It is submitted that applicant has been implicated in this case on the basis of attributing motive without any corroborative evidence for the same. There is no eye witness of the alleged incident. He further submits that co-accused of this case namely, Vipin, cousin of the deceased, having similar role has been granted bail by the co-ordinate bench of this Court, vide order dated 17.10.2022 in Criminal Misc. Bail Application No.40817 of 2022, therefore, the applicant is also entitled for bail. The applicant is languishing in jail since 01.04.2021. The applicant does not have any previous criminal history. In case, she is released on bail, she will not misuse the liberty of bail and will cooperate in the trial by all means. Lastly, it is submitted that there is no chance of applicant fleeing away from judicial process or tampering with the witnesses.
