It is submitted that in this case the allegation of assault between the parties was also made in the F.I.R. but during investigation such allegation was not found to be established, ultimately, charge sheet has been submitted under Sections 419, 420, 504, 506 I.P.C. It is further submitted that the applicant is bona fide purchaser and the informant has not named the person who sold the land that is Shiv Murat in the F.I.R. but implicated him though he purchased the land by paying consideration. It is also submitted that by the Revenue Authorities mutation was done in favour of the applicant and it was not challenged before the Superior Authorities by the informant, therefore, it has become final and now the applicant is recorded as tenure holder of the aforesaid land. Further submitted that a civil suit for cancellation of sale deed has already been filed by the wife of the informant against the applicant and other co-accused persons which is still pending.
