Present Anticipatory Bail Application has been filed with the prayer to grant anticipatory bail to the applicant - Hazik @ Hazik Siddiqui in Case Crime No. 0658 of 2022, under Sections 498-A, 323, 504, 506, 452 I.P.C. and 3/4 of the Muslim Women (protections of rights on Marriage) Act, 2019, Police Station - Tajganj, District - Agra.

Heard learned counsel for the applicant as well as the learned AGA and perused the material available on record.

In compliance of the directions given by this Court vide order dated 18.5.2023, no instructions have been obtained by the learned AGA on the point as to whether any attempt is being made by the police to arrest the applicant in this case, as the alleged offences are punishable with the imprisonment for a maximum period of seven years and it has become a regular feature from the State side that report called for by the Court is not made available within the stipulated period which is a very sorry state of affairs.

In this matter, investigation is going on and the alleged offences are punishable with the imprisonment for a maximum period of seven years. The applicant is well protected from arrest by virtue of the provisions of Section 41-A CrPC for the offences punishable upto seven years' imprisonment and in view of the law laid down by the Hon'ble Supreme Court in Arnesh Kumar vs. State of Bihar and another, (2014) 8 SCC 273 . There is no need to proceed further in the matter.

With these observations, the application stands disposed of accordingly.
