Heard learned counsel for the applicant and the learned AGA appearing for the State.
This application u/s 483 Cr.P.C. has been filed seeking direction to the trial court to decide the Special Trial No. 111 of 2018, under Sections 363, 366, 376 IPC and Section 3/4 of POCSO Act, PS Baghuachughat, District Deoria, pending in the Court of learned Special Judge, POCSO Act, First Deoria, within a stipulated time.
Learned counsel for the applicants submits that cognizance in the aforementioned case has been taken on 25.10.2018 and at present the case is fixed for prosecution evidence. It is further submitted that only examination-in-chief of the informant has been recorded so far.
Having regard to the facts and circumstances of the case and having considered the submissions made by the learned counsel for the parties, learned Special Judge, POCSO Act, First Deoria, is directed to decide the aforesaid case expeditiously, preferably within a period of one year fixing short dates, if there is no legal impediment. It is further directed that the parties shall cooperate in the proceeding and no unnecessary adjournment will be sought/granted.
With the above observations, the application stands disposed of.
