Heard Ms. Sakshi Patel, the learned counsel for applicants and the learned A.G.A. for State.

Perused the record.

This application under Section 482 Cr.P.C. has been filed for a direction to the Principal Judge Family Court, Jaunpur to decide Complaint Case No. 1082 of 2022 (Nasiba and others Vs. Salman) under Section 125 Cr.P.C. P.S. Karaudi, District-Naunpur the within time period fixed by this Court. 4. At the very outset, learned counsel for applicant submits that accused/opposite party-2 has not yet appeared in aforementioned complaint case. She therefore submits that present application under Section 482 Cr.P.C. is misonceived at this stage. It is then urged that she be permitted to withdraw the present application at this stage with liberty to file fresh at appropriate state.

Prayer made for is bonafide. The same is not opposed by learned A.G.A. Accordingly, it is allowed.

In view of above, present application is dismissed as not pressed with liberty to file fresh at apppriate stage. Order Date :- 2.3.2023 YK
