Perused the record.
This application under Section 482 Cr.P.C. has been file for a direction to court below to decide Maintenance Case No. 682 of 2021 (Sarita Devi Vs. Amarjeet Yadav) under Section 125 Cr.P.C., Police Station-Paniyara, District-Maharajganj pending in the court of Principal Judge, Family Court, Maharajganj within a time period fixed by this Court.
At the very outset, the learned counsel for applicants fairly submits that since accused-oposite party 2 has not yet appeared before court below, therefore, he be permitted to withdraw the present application at this stage with liberty to file fresh at appropriate stage.
Prayer made by the learned counsel for applicants is not opposed by the learned A.G.A.
Accordingly, present application is dismissed as not pressed at this stage with liberty to file fresh at appropriate stage.
