Heard learned counsel for the applicant and learned A.G.A for the State-respondent.

The applicant has preferred the present Application under Section 482 of Code of Criminal Procedure, 1973 for quashing the entire proceeding of the criminal case as well as the summoning order dated 12.06.2018 and charge-sheet dated 06.06.2018 in Criminal Case No. 5511 of 2018 (State Versus Ram Asare) arising out of Case Crime No. 384 of 2018, under Sections 420, 406 of I.P.C., P.S. Cantt, District- Varanasi, pending in the Court of Additional Chief Judicial Magistrate-VII, Varanasi as well as to stay the further proceedings in the aforesaid criminal case.

After some arguments, learned counsel for the applicant prays that the applicant be permitted to move appropriate application before the Court concerned as provided under Section 227 of the Cr.P.C.

This prayer has not been opposed by the learned A.G.A.

¶9

Considering the facts and circumstances of the case, the applicant is permitted to appear before the concerned court within 15 days from today and move an application under Section 227 of Cr.P.C. claiming discharge. The concerned court shall after hearing the counsel decide the application on merits, in accordance with law expeditiously.

For a period of 30 days, no coercive action will be taken against the applicant.

With the above observations, this application stands disposed of.
