Heard learned counsel for the applicant and learned AGA for the State.

It is submitted by learned counsel for the applicant that the present application is filed seeking a direction to the Special Chief Judicial Magistrate, Varanasi to decide the Misc. Case No. 2942 of 2022 (Muzeeb Ahmed Vs. Aniya Sultana) filed for recall of the order dated 13.3.2019. It is submitted that the aforesaid recall application has been filed on 29.8.2022, however till date no order has been passed.

Learned AGA submits that the case will be decided in accordance with law in a time bound manner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, it is hereby directed that the Special Chief Judicial Magistrate, Varanasi shall decide the Misc. Case No.2942 of 2022 (Muzeeb Ahmed Vs. Aniya Sultana) within a period of four months from the date of production of a certified copy of this order without giving any unnecessary adjournment to any of the parties.

With the aforesaid direction, the application under Section 482 Cr.P.C. is disposed of.
