Heard learned counsel for the applicant and learned A.G.A. for the State.

The present 482 Cr.P.C. application has been filed to quash the entire proceedings in Criminal Case No.2312 of 2012, Case Crime No.125 of 2012, under Sections 406, 419, 420, 467, 468, 471 & 120-B IPC, Police Station Kasya, District Kushinagar, pending before Civil Judge (SD) / Additional Chief Judicial Magistrate, Kasya, District Kushinagar.

Learned counsel for the applicant submitted that applicant has challenged the proceeding which was initiated in the year 2012 and till today no charge has been framed. During investigation no cogent evidence collected by Investigating Officer to implicate the applicant. Applicant was not named in the FIR, his name has surfaced during investigation thereafter the applicant has implicated in the present case. During course of the argument, learned counsel for the applicant submits that applicant wants to move discharge application and the same may be decided within stipulated period.

Learned AGA has no objection in allowing the aforesaid prayer of the applicant.

Considering the arguments raised by learned counsel for the applicant and perused the entire records; the present 482 Cr.P.C. application is disposed of with the direction that the applicant may move discharge application within three weeks from today. If the said application is moved within stipulated period, the same shall be considered and decided, in accordance with law, within a period of one month from the filing of the said application.
