Heard learned counsel for the applicant and perused the record.
This petition had been moved to direct the J.M., Ghaziabad to decide Case Crime No. 745 of 2019 under section 323, 504 and 506 IPC P.S. Kavi Nagar, Ghaziabad within a period prescribed by this Court
Learned Counsel for the applicant informed that in view of the judgement Asian Resurfacing of Road Agency Pvt. Ltd. and Another Vs. C.B.I. (2018) 16 SCC 299. The learned Trial Court has already proceeded with the case.
Learned counsel for the applicant prays for and is permitted to withdraw the present petition.
Accordingly, the petition is dismissed as withdrawn.
