Heard Sri Vinay Kumar Tiwari learned counsel for the applicants and S.K. Tripathi holding brief of Alka Pandey learned counsel for the opposite party no.2 and perused the record.
The present application under section 482 Cr.P.C. has been moved with the prayer to quash the charge sheet dated 07.06.2019 arising out of Case Crime No. 745 of 2019 under section 323, 504, 506 IPC, P.S. Kavi Nagar, District Ghaziabad pending in the court of A.C.J.M., Ghaziabad.
The trial Court has proceeded with the aforesaid case in view of the judgement of Asian Resurfacing of Road Agency Pvt. Ltd. and Another Vs. C.B.I. (2018) 16 SCC 299. The applicants have not obtained bail till date. The case under 323, 504 and 506 IPC is almost bailable in nature. Therefore, it is directed that if applicants move bail application before the concerned Court, the same shall be decided in view of the judgement of Satendra Kumar Antil vs. Central Bureau of Investigation and another reported in ( 2021) 10 SCC 773 .
For a period of four weeks from today, no coercive action shall be taken against the applicants.
